Integrated Project Delivery and Professional Liability Concerns

Chuck Heuer, Esq., FAIA, is principal of the Heuer Law Group and the developer and president of LegaLine, The AIA Trust’s prepaid legal information service and advisory program. Previously he was staff director of the AIA Documents Program and in-house counsel at The Architects Collaborative. Heuer is the author of Means Legal Reference for Design and Construction, has authored chapters of The Architect’s Handbook of Professional Practice dealing with design and construction contracts, and wrote the Commentaries on the 1987 Editions of the major AIA Documents. He is currently reviewing the new AIA documents on the digital transfer of information and on general integrated practice to provide architects with educational programs.

Lorna Parsons, Hon. AIA, is managing director of Schinnerer’s Construction Industry Group. Partnering with CNA, Schinnerer’s 50-year-old program of professional liability insurance for design firms is the longest running program of its kind. Lorna has been the insurance advisor for the AIA Documents Committee, insurance liaison for the AIA Risk Management Committee and the Professional Liability Committee of the National Society of Professional Engineers, and is active with the insurance trust and risk management committee of the American Council of Engineering Companies.

The integration of design and construction activities is accelerating, and this collaborative design process is radically refabricating professional practice as it explores new ways to give the client a better project.

At the same time, the many creative forms of integrated practice challenge well-founded legal principles and insurance coverage products—which, by necessity, follow rather than lead business and professional transformations. To lead future forms of collaboration and integrated practice, an understanding of these issues is vital.
